Jan 4, 2006    The attorney present to represent Les Stipek was: James Bastien.   He is going to file a Motion to convert the Chapter 11 bankruptcy to a Chapter 7 bankruptcy.   He took time to talk to us in the hall after the ruling, and will send us all a notice to explain and set a hearing date.

As I understand it, Chapter 11 is preparation, Court approval, and implementation of a "reorganization plan" and requires a lot of administration, compiling large administrative costs.

Chapter 7 is the liquidation of all assets for distribution to the creditors.   They feel the conversion to Chapter 7 is in the best interest of all parties since the assets are of a long-term nature, as this will minimize costs.   They will use the "plan" process and we will get the same amount back, under either process.

The "plan" they are projecting is as was stated in the first hearing.   They feel the primary source of recovery will be income from the oil companies.   (I think these are the long-term assets they were referring to.)

Karen Naylor, the Chapter 11 Trustee, has agreed, and the Court will ask for her to be reappointed as the Chapter 7 Trustee, for the sake of consistency.   She has stated, however, that she is not interested in becoming the General Partner to administer the "plan," which would oversee distributions to the creditors on a long-term basis.   The Court will be asked to appoint a new Partner to administer.   The name suggested so far is John Wolfe, an accountant with a lot of dealing with oil companies, etc.

The tentative date set for the Court to receive status is March 15.   This date will most likely be changed when we receive the actual notice of the Motion to Convert to Chapter 7.

CDs of 341(a) examinations are maintained by the U.S. Trustee's office for 5 years from the date of the examination.   After that, they are destroyed.

Note: The CDs are recorded in a standard MP3 (MPEG) format, to be played on a computer using RealPlayer or Windows Media Player.   It will not play in a car CD player.
